A very common area of disability involved spinal (neck adn back) injuries. These injuries can be very debilitating, especially in the medical, dental and construction, and other physically-demanding professions.
Typical issues involving the injuries include:
1. The type of medical treatment received
2. The precise diagnosis
3. Whether there is objective evidence of the condition ( such as x-rays, MRIs or CT scans)
When a herniated or bulging disc is impinging on a nerve these conditions can be quite problematic.
In cases where the insurance carrier is questioning a spinal or back injury or the severity of an insured's conditionm the carrier should offer an objective, fair and independent Independent Medical Examination (IME). Sometimes an insurance company wishes to avodi teh possibility of an IME confirming the disability, so, instead, it performs an in-house paper review of the medical records adn then simply "disagrees' with the treating physician.
In addition to the debilitating nature of these types of injuries in and of themselves, the medication prescribed can also cause problems. Such medications must also be considered by the company as a disabling factor when evaluating the disability.
